Terms

These terms are an agreement between you and Colin Petty Solutions, LLC, a Texas limited liability company doing business as prospects.fyi (“prospects.fyi”, “we”, “us”). They cover prospects.fyi, beta.prospects.fyi, the morning email and the prospects.fyi connector for ChatGPT and Claude (together, “the service”). By using the service you agree to them. If you use it for your employer, you agree on its behalf and confirm you are allowed to.

What the service is

prospects.fyi helps sales people build and work a list of companies to sell to: it writes research prompts for the assistant you already use, keeps the companies and contacts you bring back, researches a few new ones for you every weekday morning if you ask it to, and helps you write and keep track of outreach. It is free today. If that ever changes, we will tell you before anything is charged, and nothing will be charged without your agreement.

Your account

• You must be at least 18 and using the service for business.
• Sign in with an address you control. You are responsible for what happens under your account, including through the link in your morning email, which signs you in for the day it was sent. Please do not forward that email.
• Tell us at colin@prospects.fyi if you think somebody else is using your account.

Research, and who owns it

Two kinds of thing come into the service, and they are treated differently.

• Research is information about companies and the people who work there: names, locations, what they do, what changed, phone numbers, email addresses, titles and where each was found. That includes research we do for you and research you bring back from your own assistant. You grant us a perpetual, irrevocable, worldwide, royalty-free licence to keep, use, verify, combine and build on that research, including to research for other users. The resulting database belongs to us.
• Your own work is what you add yourself: notes, ratings, next steps, calls you mark, email campaigns, people and addresses you type in by hand, the customers you name, and the fact that you hold a company. It stays yours. We use it only to run the service for you, and we never show it to another user. Ratings may be used added up across many people, never as yours.

We never hand anybody a company that somebody at their own firm already holds, and we never tell anybody who holds a company. The privacy page says exactly what is stored.

Using research responsibly

• Research comes from public sources and from AI assistants, and it can be wrong or out of date. An email address marked “pattern” is a likely address, not a confirmed one. Check anything that matters before you rely on it.
• You are responsible for the outreach you send. That means following the laws that apply to it, including CAN-SPAM for email and the TCPA and do-not-call rules for calls and texts, and honouring any request to stop.
• Do not use the service to harass anybody, to send bulk unsolicited mail, or to collect information about people for anything other than business-to-business selling.

What you may not do

• Scrape, copy or resell the service or the database, or try to get at other users’ data.
• Interfere with the service, get round its limits, or use it to build a competing product.
• Put anything into it you do not have the right to share.

Other services

The prompts run in ChatGPT, Claude or whichever assistant you choose, under that provider’s own terms. Mail you send from the service opens in your own mail program. We are not responsible for those services.

No warranty

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that it will be uninterrupted, that the morning email will arrive every day, or that any prospect will buy anything.

Limits on liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising from the service. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

Indemnity

You will defend and hold us harmless from claims arising from your outreach, your content or your breach of these terms.

Ending it

You can stop at any time: unsubscribe from the morning email with one press, or delete your account on the privacy page. We may suspend or end an account that breaks these terms or puts the service or other users at risk. The sections on research ownership, no warranty, limits on liability, indemnity and governing law survive.

Changes

We may update these terms. If a change is material we will say so on the site or by email before it takes effect, and continuing to use the service afterwards means you accept it.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Texas, and you and we consent to their jurisdiction.
